STRA Compliance – Short Term Rental Accommodation Compliance

New South Wales (NSW) has introduced several compliance requirements for Short-Term Rental Accommodation (STRA) as of 2025.

Mandatory Registration

All STRA properties must be registered with the NSW Government’s STRA Register. Registration is $65 and then must be renewed annually, with a fee of $25. Failure to register can result in enforcement actions by local councils.

Night Caps

In New South Wales, non-hosted short-term rental properties (where the host does not reside on-site) are subject to annual night caps that vary by location. Greater Sydney typically allows up to 180 nights per calendar year, while some high-demand areas like Byron Shire enforce stricter limits, in some cases as low as 60 nights annually. These limits are designed to balance the needs of tourism with housing availability. However, longer bookings generally 21 consecutive days or more are exempt and do not count towards the cap. Exceeding the allowable nights may result in enforcement action from local councils, as it can be considered a breach of planning regulations.

Fire Safety Standards

STRA properties must adhere to mandatory minimum fire safety standards.

Code of Conduct

Host Obligations: Hosts must be accessible between 8:00 am and 5:00 pm for general issues, and outside these hours for emergencies. They are also required to inform neighbours of their STRA activities and provide contact details.

These changes aim to balance the benefits of short-term rental accommodation, including to the tourism economy, and encouraging more supply of long-term rental accommodation in NSW.
